Article 1 - Object :
The present general terms define rights and obligations of parties within the framework of offered services by the company BEBE-LOCATION to the hirer.
Article 2 - Entire agreement :
The present general terms express the entirety of the obligations of parties. In this way, the hirer has to accept the entirety of dispositions envisaged in these general terms. The present general terms are applied with the exception of all other conditions applicable on the site. BEBE-LOCATION reserves the right to change the general terms of sale at any time.
Article 3 - Activity :
The BEBE-LOCATION company hires out childcare equipment to private individuals and professionals for a 20 € minimum order. The term of hire can vary, but always for a maximum term of 6 months, subject to availability while stocks last.
Article 4 - Items :
BEBE-LOCATION promises to hire out the items according to regulations in force, clean and operative. If the item chosen initially by the hirer is temporarely out of stock, BEBE-LOCATION promises to replace it with an other from an equivalent range at no extra charge.
Article 5 - Duration of hire :
The date and time of delivery and collection are set by the hirer and the owner during the reservation. Every start day is invoiced as a complete day. The hire takes effect from the instant when the item is at the disposal of the hirer at the place of delivery, at the date and time agreed between the hirer and the owner. A pre-reservation by telephone will not be considered as a company order.
The duration of hire is invoiced to the hirer regardless of events that reduce number of days of the item would be used, and even in case of advance return. Any hire extension of duration must be processed as a new order. In this case, the daily rate will be applied to the new order.
Article 6 - Equipment delivery :
Equipment delivery is made by appointment from Monday to Sunday in a place agreed during ordering. BEBE-LOCATION reserves the right to cancel reservation of pre-reserved equipment, if the equipment cannot be delivered at the date and time defined on the order.
Article 7 - Equipment collection :
Collection is made by appointment at the date and place agreed on the order. The hirer is responsible for all obligations as stated in the agreement, until BEBE-LOCATION collects, he will remain keeper of hired equipment and is obliged to keep it under surveillance. After 24 hours, if the equipment is not returned to BEBE-LOCATION it will be considered the property of the client and the refundable deposit will be cashed by BEBE-LOCATION without any further recourse for the hirer.
Article 8 - Equipment disposal :
The hirer admits receiving clean and operative items with instructions for use. The hirer declares to have checked the equipment and chosen it to correspondent to his needs. BEBE-LOCATION cannot be held responsible in this case.
Article 9 - Use :
The hirer promises to install and use the equipment as designated according to regulations in force, with caution, to respect instructions and notices of use and safety. The hirer is responsible for protecting the hired equipment against any deterioration, and use it in accordance with instructions. He will refrain from any modification, development or transformation of the equipment. The hirer is responsible for returning undamaged equipment, along with all accessories. Rehire and subletting of the equipment is strictly forbidden.
BEBE-LOCATION will check that equipment is clean and operative after every collection. If the collected item is aesthetically or repairably damaged, but which does not endanger the safety of the equipment, the client will be invoiced for an all-inclusive price of 20 €. If the hired product is damaged or broken beyond repair, making this equipment unusable and impossible to rehire, then BEBE-LOCATION will cash refundable deposit. BEBE-LOCATION reserves a delay of 3 working days after collection to declare equipment deteriorations not visible or not reported by the hirer.
Article 10 - Payment terms :
All payment cash only. The total payment must be is made on delivery, in cash. Before payment the hirer promises to read accept and approve the present general terms of sale and also the particular terms of hire agreement specified in the conditions.
Article 11 - Refundable deposit :
An identity card (or proof of identity) plus a refundable deposit to the commercial value of the product will be required on delivery. The refundable deposit must be made in cash (or by cheque for french people) on delivery. If the present agreement conditions are not respected by the hirer, the latter authorizes BEBE-LOCATION to cash the refundable deposit.
BEBE-LOCATION promises not to cash the refundable deposit during the hire term, and to return cheque or cash when collecting hired product after equipment check, if all conditions of the present agreement are respected by the hirer.
Article 12 - Clause limitations of liability proper to BEBE-LOCATION :
Loss / Theft : the hirer is responsible for equipment in case of loss or theft. In this instance BEBE-LOCATION is released from any obligations or responsibilities in case of loss or theft and the refundable deposit will be cashed.
Incorrect usage of equipment : BEBE-LOCATION cannot be considered, under any circumstances, as responsible for incorrect usage of equipment which results in harm or physical damage.
For any event beyond the control of BEBE-LOCATION (strikes, riots, natural disasters and acts of God), the company cannot be held responsible for possible repercussions on the hire agreement, such as delivery time not respected or equipment unavailability.
Article 13 - Litigation regulations :
The present general terms of sale are subjected to french law. In case of litigation, competence is allocated to Strasbourg competent courts jurisdiction.
